1. Introduction

This agreement ("Terms") governs your use of the services provided by Penis Friends ("we," "us," or "our") through penisfriends.com. By placing an order with us, you agree to these Terms.

2. The Services

We provide custom digital illustration services, creating a unique "Custom Penis Friend" based on your provided reference photos and description. Our standard delivery time is 72 hours from the moment your payment is confirmed and all required materials (photo, handle, vibe) are submitted.

3. License Grant: Commercial-Lite

When you purchase a "Custom Penis Friend," you are granted a "Commercial-Lite" license. This license allows you to use your friend for:

• Social media posts, avatars, and streaming.

• Up to 100 physical units or $1,000 in gross sales (whichever comes first).

• Giving credit to "Penis Friends™" where possible.

You are prohibited from:

• The resale of the source image as-is.

• Minting the artwork as an NFT.

• Sublicensing the artwork to a third party.

• Using the artwork for commercial purposes exceeding the stated limits without purchasing an upgrade.

4. Customer Responsibilities

You agree to provide us with a clear, usable photo and a description that is not misleading or fraudulent. You acknowledge that we are not responsible for delays caused by you failing to provide the necessary materials or respond to our requests for clarification.

5. Redo Guarantee & Revisions

We offer a 100% Redo Guarantee. If you are unhappy with the final result, we will perform one full redraw at no additional cost within 7 days of the final delivery. Additionally, you are entitled to two minor tweaks within the 72-hour delivery window.

6. Payments and Refunds

All sales are final. We do not offer cash refunds. Your sole remedy for dissatisfaction is the 100% Redo Guarantee outlined in Section 5.

7. Privacy and Data

Your reference photos are used exclusively for the creation of your custom artwork. We will permanently delete your photo from our servers once your order is completed and delivered. We will not use your photo for any other purpose without your explicit written consent.

8. Intellectual Property

All artwork created by Penis Friends is protected by copyright. We retain the right to use the final artwork for promotional and portfolio purposes unless you explicitly request otherwise in writing. You, the customer, are granted the license as described in Section 3.

9. Limitation of Liability

In no event shall Penis Friends be liable for any damages arising out of your use of our services. Your use of the service is at your sole risk.

10. Governing Law

This agreement shall be governed by the laws of the State of Ohio.
